Overview
These Terms and Conditions (“Terms”) govern your access to and use of the Diamond Pool Maintenance website at diamondpoolmaintenance.com and your engagement of our pool maintenance, repair, renovation, and inspection services. By using our website or entering into a service agreement with us, you agree to be bound by these Terms.
1. Use of Website
- Violates any applicable federal, state, or local law or regulation
- Infringes on the intellectual property rights of Diamond Pool Maintenance or any third party
- Attempts to gain unauthorized access to any part of our systems or infrastructure
- Transmits unsolicited commercial communications or spam
- Interferes with the proper functioning of the website
2. Service Agreements
- Services begin upon execution of a signed agreement and receipt of any required initial payment
- Monthly recurring services are billed at the beginning of each service period
- Balances not paid within invoice terms are subject to a 0.75% monthly finance charge
- Either party may terminate month-to-month services with 30 days’ written notice after the completion of any initial commitment period specified in the service agreement
- Website design, build, or migration projects included with service agreements become payable at the standard project rate if the service agreement is terminated before the agreed minimum term is completed
- Diamond Pool Maintenance reserves the right to suspend services on accounts more than 15 days past due
3. Client Responsibilities
- Provide accurate property access information (gate codes, lockbox combinations) and update us promptly when access information changes
- Maintain a hazard-free environment around the pool equipment pad and pool area during scheduled service visits
- Respond in a timely manner to communications regarding equipment concerns, approval requests, or scheduling matters
- Provide honest and complete information about the pool’s history and any known issues when establishing service
4. Limitation of Liability
Diamond Pool Maintenance performs all services in good faith and to a professional standard. We do not guarantee specific outcomes including, without limitation, water clarity targets, equipment lifespan, or absence of algae growth. Pool conditions are influenced by factors outside our control including weather, bather load, equipment age, and pre-existing conditions.
Our total liability for any claim arising from services rendered shall not exceed the total fees paid to Diamond Pool Maintenance in the 30-day period immediately preceding the claim. Diamond Pool Maintenance is not liable for pre-existing equipment failures, manufacturer defects, acts of nature, or damage arising from a client’s failure to follow professional recommendations.
5. Intellectual Property
All content on this website — including text, photography, graphics, logos, and overall design — is the property of Diamond Pool Maintenance or its licensed content providers and is protected by applicable United States copyright and trademark law. You may not reproduce, distribute, republish, or use any website content for commercial purposes without prior written permission from Diamond Pool Maintenance.
